"Read The Archive" and associated logos are trademarks of Black Box Innovations LLC. You may not use these marks without our prior written permission.
Your privacy is important to us. Our collection and use of information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
THE SERVICE IS PROVIDED ON AN "AS AVAILABLE" BASIS. We do not guarantee that the Service will be available at all times or that it will be uninterrupted, timely, secure, or error-free. The availability of archived content depends on third-party services (Archive.today) which we do not control.
You may stop using the Service at any time by deleting the App from your device.
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE PAST TWELVE (12) MONTHS, OR (B) ONE HUNDRED DOLLARS ($100).
You agree to defend, indemnify, and hold harmless Black Box Innovations LLC from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from your use of the Service or your violation of these Terms.

Before initiating any arbitration or court proceeding, you agree to first contact us at hello@readthearchive.com and attempt to resolve any dispute informally within thirty (30) days.
Any dispute arising out of or relating to these Terms or the Service shall be determined by binding arbitration administered by JAMS in accordance with its Streamlined Arbitration Rules. The arbitration shall be conducted by a single arbitrator in Wilmington, Delaware.
YOU AND BLACK BOX INNOVATIONS LLC AGREE THAT ANY CLAIMS WILL BE RESOLVED ON AN INDIVIDUAL BASIS. NEITHER YOU NOR WE SHALL HAVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION.
You may opt out of this arbitration agreement by sending written notice to hello@readthearchive.com within thirty (30) days of first accepting these Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
We reserve the right to modify these Terms at any time. If we make material changes, we will update the "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Black Box Innovations LLC regarding the Service. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right shall not be deemed a waiver. You may not assign these Terms without our consent.
